Gatco residents stay application fixed on Aug 15
The hearing for Kampung Gatco settlers' application for a stay on the Kuala Lumpur High Court's judgment against them has been fixed on Aug 15.
Lawyer R Kenghadharan who represented the settlers told reporters that the stay application is scheduled to be heard by Justice Hue Siew Kheng.
Today was initially fixed for the hearing for assessment of damages to be paid by the settlers to the company which owns their land - Thamarai Holdings Sdn Bhd, as they were barred from gaining access to the land and conduct land clearing.
The hearing for the assessment of damages is scheduled on Sept 7 and 8. The settlers are appealing against paying the damages at the Court of Appeal, which will be heard on Sept 15.
According to Kenghadharan, the court also instructed finding Tamil interpreters as most of the settlers cannot speak Bahasa Malaysia or English.
The settlers were part of the Great Alonioners Trading Corporation Bhd (Gatco), a company incorporated in 1977 by the National Union of Plantation Workers (NUPW) to facilitate a land development scheme for the NUPW members, in Bahau, Negeri Sembilan.
Some 430 families took part in the scheme comprising 200 Indians, 120 Malays, and 30 Chinese forming Kampung Gatco or Kampung Serampang Indah.
The settlers moved into the area which is near Bahau, Negeri Sembilan in 1977, and they were part of the Great Alonioners Trading Corporation Bhd (Gatco), a company incorporated in 1977 by the National Union of Plantation Workers (NUPW) to facilitate a land development scheme for the NUPW members.
Some 430 families took part in the scheme comprising 200 Indians, 120 Malays, and 30 Chinese forming Kampung Gatco or Kampung Serampang Indah.
The current settlers had paid RM7,600 each as a deposit to settle on allocated plots of the land as part of the development scheme.
However, the scheme eventually failed and the land was changed to two financial institutions.
Gatco eventually wound up but its liquidators sold the land to Thamarai Holdings Sdn Bhd in 2006, triggering the tussle.
It was reported that some settlers were arrested for not allowing the company to encroach the disputed land.- Mkini
