raus2PUTRAJAYA: There is no oath taking ceremony for Chief Justice Raus Sharif to be made an additional judge of the Federal Court.
Federal Court Chief Registrar Latifah Mohd Tahar said “there is no event in the Palace of Justice today”.
However, she invited the media to attend the Excellence Service Award for court staff here tommorrow as Raus will officate the event.
Normally, an additional judge of the Federal Court takes his oath of office before the chief justice or, in the absence of the chief justice, before the next most senior judge as provided under Article 124 (4) of the Federal Constitution.
The king has to also hand over the instrument of appointment before Raus takes his oath of office.
Reporters spotted Raus walking with a group consisting of former chief secretary to the government Mohd Sidek Hassan and High Court judge Kamaludin Md Said in the Palace of Justice around noon.
Latifah was with the group.

However, the prupose of Sidek’s presence could not be determined. He has been appointed as chairman of the Royal Commission of Inquiry into forex losses by Bank Negara in the 1990s.
Kamaludin is a member of the panel. Also spotted were government lawyers Muhammad Saifuddin Hashim and Suhaimi Ibrahim.
Malaysian Bar president George Varughese said he was not notified to attend the appointment ceremony of Raus as an additional judge or his continuance as chief justice.
The Bar has decided to file a suit to challenge the appointments of Raus and Court of Appeal president Zulkefli Ahmad Makinudin as additional judges so that they can remain in their posts.
Varughese said the unprecedented move would be made “very soon.”
An overwhelming majority of lawyers who attended the Bar’s extraordinary general meeting (EGM) voted to say the appointments of Raus and Zulkefli were unconstitutional.
Varughese said the Bar also took the position that serving Federal Court judges should not hear the matter since they would be in a position of conflict of interest.
“We therefore call upon the Chief Judge of Malaya Ahmad Maarop to advice the king under Article 122 (1A) of the Federal Constitution to appoint persons who had held high judicial office as additional judges for the sole purpose of hearing and determining the said legal challenge,” he told a Press conference yesterday.
Varughese said Ahmad could invoke Article 131A, read together with Section 9 of the Courts of Judicature Act 1964, which allowed the most senior judge to exercise the powers of the chief justice during his incapacity or absence.
He said the EGM also decided that the Bar would not extend an invitation to Raus and Zulkefli to attend its social events.
Four weeks ago, the government appointed Raus and Zulkefli as additional judges.
The king, on the advice of the prime minister and after consulting the Conference of Rulers which met in May, also reappointed Raus and Zulkefli to their present posts.
Raus’ tenure is for three years from today while Zulkefli will remain in his current administrative post for two years from Sept 28.
Raus retired yesterday while Zulkefli retires on Sept 27 after reaching the mandatory retirement age.
Most lawyers and retired judges are of the view that no Federal Court judge can remain in his administrative post after reaching 66 years and six months of age.
Yesterday, Pakatan Harapan leaders submitted a memorandum to the king, seeking his intervention to stop the re-appointments of Raus and Zulkefli, which they also claimed were unconstitutional. - FMT
