BATH – A second attempt failed to remove Republican Patrick McAllister from the Independence Party line for Steuben County Surrogate Court Judge when the New York State Supreme Court ruled Friday (Aug. 11) in McAllister's favor and against the challenge.“The Supreme Court has ruled that the challenge is invalid,” said former Steuben County Republican Chairman William Hatch. “Patrick McAllister remains a candidate for Surrogate Judge. This is a victory for all voters, who are now assured of having a choice in the election.”
The state court upheld the 4-0 bipartisan decision on July 26 by the Steuben County Board of Elections commissioners and deputy commissioners in favor of voter petitions securing McAllister a spot on the Independence Party line.
The challenge, filed by surrogate judge candidate Chauncey Watches’ campaign, centered around a military veteran’s petition which included a bar through the number “7” – a standard military notation. The challenge claimed the number was a “2” instead, which would have invalidated the veteran’s petition. The court ruled the number was a “7” and the veteran’s entry was valid.
The state court decision means McAllister will be on the Republican, Conservative and Independence party lines for the Sept. 12 primary day.
