An Attica man will serve probation, not jail time, for driving drunk in Cuba with a 1-year-old child in the vehicle. In Allegany County court today, Judge Thomas Brown sentenced 35-year-old Brian Phearsdorf to four years probation. Prosecutors said he was stopped by police on Route 305 and charged with aggravated DWI with a child in the vehicle, a charge he later pleaded guilty to. Beyond probation, Judge Brown sentenced Phearsdorf to install an ignition interlock for three years, pay $1,000, $520 in surcharges, a $50 DNA fee and he must attend a victim impact panel. In addition, Phearsdorf will have his license revoked for one year.
