Andover man receives probation in Criminally Negligent Homicide case

On October 22, 2017, Gregory M. Dunne, 18, of Andover, was taken to Jones Memorial Hospital in Wellsville where he was pronounced dead on arrival. State police said at the time that Elliott and two others drove from Allegany County to the Rochester area to purchase heroin. During the trip to Rochester, Dunne was snorting heroin and was observed to have become unconscious but was still breathing. While commuting back from Rochester and presumed Dunne was asleep, they noticed Dunne was not breathing. They tried to wake Dunne with no results.
Just days after the death, Elliott has arrested for twice selling heroin to an agent of the Wellsville Police Department. Once in Almond on October 22, 2017 and the next day in Wellsville. The case was prosecuted by Assistant District Attorney Thomas Fuoco. Elliott was represented by Roy Bielewicz.
