Sex offender convicted in Allegany and Cattaraugus counties wins Appellate victory
An Olean man who was convicted of sex crimes in both Allegany and Cattaraugus Counties has won a court ruling to have his sex offender risk level reduced. In 2001, now 39-year-old Kyle E. Miller was convicted in Cattaraugus County Court of attempted sodomy and, that same year, he was convicted in Allegany County Court for sexual abuse in the first degree. He received a three-year prison sentence. As a registered sex offender, Allegany County classified Miller as a Level 2 offender…which is mid-level. However, Cattaraugus County labeled him a level three or high-risk offender. In a two-page decision, a New York State Appellate Court found flaws with the Cattaraugus designation and vacated the Level 3 classification. You can read the entire decision HERE.
